Public offer agreement

General provision

1.1. This offer, in accordance with the Civil Code of Ukraine, is an official offer of FOP Mostypanskiy I. O., hereinafter referred to as the “Seller”, to conclude an Agreement for the sale of goods remotely, that is, through an online store, hereinafter referred to as the “Agreement”, and places the Public Offer (offer) on the Seller's official website www.elitmolds.com (hereinafter referred to as the "Website").

1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to conclude a contract for the sale of goods is the fact that the Buyer pays for the order on the terms of this Agreement, on time and at the prices indicated on the Seller's website. Concepts and definitions

2.1. In this offer, unless the context otherwise requires, the following terms have the following meanings: "goods" - models, accessories, components and accompanying items; "Internet store" - the Seller's website, created for the conclusion of retail and wholesale sales contracts on the basis of the Buyer's familiarization with the description of the Goods proposed by the Seller in photographs, using the Internet, which excludes the possibility of the Buyer's direct acquaintance with the Goods, that is, the remote method of sale Goods. "Seller" - a company that sells goods presented on the Internet site. "Buyer" - an individual who has entered into an Agreement with the Seller on the terms and conditions set forth below. "Order" - selection of individual items from the list of goods specified by the Buyer when placing an order and making payment using a payment card. Subject of the Agreement

3.1. The Seller undertakes to transfer the Goods to the Buyer's ownership, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement. This Agreement governs the purchase and sale of goods in the online store, including: voluntary choice by the Buyer of goods in the online store; independent registration by the Buyer of the order in the online store; payment by the Buyer of the order placed in the online store; processing and delivery of the order to the Buyer in the property on the terms of this Agreement. 4.1. The buyer independently places an order in the online store through the "basket form", or by placing an order by e-mail, or by phone number specified in the contact section of the online store.

4.2. Order formation time - up to 2 working days from the date of registration of the application. If the order is placed on a weekend or holiday, the formation period starts from the first working day after the weekend. Order payment procedure

5.1. The Buyer pays for the Order using the service - Online payment WayForPay.

5.2. After making a payment and receiving a positive response (confirmation) about payment from the Bank's server, a page with the Order number, date and time of delivery is displayed on the screen. Terms, cost and terms of delivery of the order

6.1. Delivery of the order is carried out by the Seller and the transport company within the period specified in the Order (agreed) with the Buyer after the actual payment for the goods, as well as after its manufacture, up to 7 working days.

6.2. If it is impossible for the Buyer to receive the goods on the agreed date and time, a new delivery date is one-time agreed with the Buyer over the phone, provided that the new delivery date cannot be later than 4 days from the first delivery.

6.3. In case of repeated non-receipt of the goods by the Buyer, for reasons beyond the control of the Seller, the order is canceled and subject to re-registration on the Seller's website. At the same time, 100% prepayment made by the Buyer is returned on the terms specified in clause 9.7. actual agreement. Rights and obligations of the parties

7.1. The seller is obliged: comply with the terms of this Agreement; fulfill the Buyer's orders in case of payment from the latter; transfer the goods to the Buyer in accordance with the selected sample in the online store, the placed order and the terms of this agreement. check the qualitative and quantitative characteristics of the goods during their packaging at the Seller's warehouse.

7.2. The seller has the right: unilaterally suspend the provision of services under this agreement in case of violation by the Buyer of the terms of this agreement.

7.3. The buyer is obliged: timely pay and receive the order on the terms of this contract.

7.4. The buyer has the right: place an order in the online store; require the Seller to fulfill the terms of this Agreement. Responsibility of the parties

8.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this agreement in the manner prescribed by this agreement and the current legislation of Ukraine.

8.2. The seller is not responsible for: the appearance of the Goods changed by the manufacturer; for minor color discrepancy
